1. Acceptance of Terms

By using our website at www.fourseasonsheatingandairconditioning.com or scheduling services with Four Seasons Heating and Air Conditioning, you agree to these Terms of Service. If you don't agree, please don't use our services.

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.


2. Our Services

Four Seasons provides HVAC services to residential and commercial customers in Stockton, CA and the Central Valley, including:

  • HVAC installation and replacement

  • AC and heating repair

  • Maintenance and tune-ups

  • Emergency services (24/7)

  • Ductwork and thermostat installation

  • Indoor air quality solutions

All services are subject to availability and scheduling.


3. Estimates and Service Agreements

Estimates

  • Valid for 30 days unless otherwise specified

  • Subject to change if unforeseen conditions are discovered

  • Non-binding until written service agreement is signed

Authorization

By scheduling service, you authorize us to:

  • Enter your property to perform work

  • Assess your HVAC system

  • Make approved repairs or installations

  • Dispose of old equipment properly

Changes to Work

If additional work is needed, we will notify you and get your approval before proceeding.


4. Pricing and Payment

Payment Methods

We accept cash, checks, credit/debit cards, bank transfers, and financing through Synchrony Home (subject to credit approval).

Payment Terms

  • Repairs/Maintenance: Payment due upon completion

  • Installations: Typically 50% deposit, 50% upon completion

  • Late Payments: 1.5% monthly fee on balances over 30 days old

Price Match Guarantee

We offer a $500 price match guarantee on written estimates from licensed competitors for comparable work. Some restrictions apply.


5. Warranties

Installation Warranty

  • 10-year parts and labor warranty on new installations

  • Valid with regular maintenance

  • Non-transferable

Repair Warranty

  • 1-year guarantee on repair work and parts

  • Covers the specific repair, not entire system

Warranty Exclusions

Warranties don't cover:

  • Acts of God or natural disasters

  • Improper use, neglect, or lack of maintenance

  • Unauthorized repairs by others

  • Normal wear and tear

  • Consequential damages


6. Customer Responsibilities

To maintain warranty and optimal performance:

  • Change air filters every 1-3 months

  • Keep outdoor units clear of debris

  • Schedule annual maintenance

  • Provide safe access to equipment

  • Secure pets during service visits

  • Notify us of hazardous conditions


7. Cancellations

Service Appointments

  • Cancel or reschedule with 24 hours notice (no fee)

  • Less than 24 hours notice: up to $75 fee

  • No-shows charged full service call fee

Installation Contracts

  • Cancel within 3 business days for full refund (California law)

  • After 3 days but before work starts: 25% restocking fee

  • After work begins: charged for completed work


8. Limitation of Liability

  • Our total liability cannot exceed the amount you paid for the specific service

  • We're not liable for indirect, consequential, or punitive damages

  • We're not responsible for pre-existing conditions you didn't disclose

  • We carry general liability insurance for accidental damage

  • Report any property damage within 48 hours


9. Website Use

Permitted Use

  • View and access for personal, non-commercial use

  • Print content for personal reference

Prohibited Use

  • Reproduce or distribute our content commercially

  • Use automated tools to access the site

  • Attempt unauthorized access

  • Remove copyright notices

All website content is protected by copyright and trademark laws.


10. Privacy

We collect and use personal information as described in our Privacy Policy. We don't sell your information. We use it to provide services, process payments, and send service reminders.


11. Dispute Resolution

If informal resolution fails, disputes will be resolved through binding arbitration in San Joaquin County, California under AAA rules.

Class Action Waiver

Disputes will be resolved individually. You waive the right to participate in class action lawsuits.


12. California-Specific Rights

Contractor License

Four Seasons is a licensed California contractor.

Three-Day Right to Cancel

You have 3 business days to cancel contracts signed at your home or workplace (doesn't apply to emergency services you requested).

Mechanics Lien Rights

Contractors can file liens if not paid for services. This can affect your ability to sell or refinance your property.


13. Emergency Services

  • 24/7 availability (response times vary)

  • During peak demand, response may be delayed

  • Emergency rates may differ from standard rates

  • For immediate danger (gas leaks, carbon monoxide): evacuate and call 911 first


14. Financing Disclaimer

Financing is provided by Synchrony Home, not Four Seasons. All terms, rates, and approvals are determined by Synchrony Home. See them for complete details.


15. Force Majeure

We're not liable for delays due to circumstances beyond our control (natural disasters, pandemics, government actions, supply chain issues, etc.).


16. General Terms

  • Age Requirement: Must be 18+ to use our services

  • Governing Law: California law applies

  • Entire Agreement: These Terms, plus any service agreements, constitute the full agreement

  • Severability: If any provision is invalid, the rest remains in effect

  • No Assignment: You can't transfer these Terms without our consent
